Green Eyes Productions LLC – Ticket Sales Terms of Service Agreement

This Ticket Sales Terms of Service Agreement (the “Agreement”) governs the sale and use of tickets for events produced by Green Eyes Productions LLC (“Green Eyes Productions,” “we,” “us,” or “our”), a limited liability company based in North Carolina. By purchasing a ticket (“Ticket”) for an event produced by Green Eyes Productions LLC (the “Event”), you (“Customer,” “you,” or “your”) agree to abide by and be bound by the terms and conditions set forth in this Agreement. Please read this Agreement carefully before purchasing any tickets.

General Ticket Terms
- Ticket Purchase:
- Tickets for events produced by Green Eyes Productions LLC are sold through our official website and/or authorized third-party ticketing platforms.
- All ticket purchases are final and binding. By purchasing a ticket, you confirm your intention to attend the Event and agree to comply with all terms of this Agreement.
- Ticket Limitations:
- Green Eyes Productions LLC reserves the right to limit the number of tickets per customer and to cancel orders that exceed the purchase limits. We reserve the right to refuse any ticket order at our discretion.
- Tickets are non-transferable unless otherwise authorized by Green Eyes Productions LLC.
- Ticket Delivery:
- After purchasing a ticket, you will receive a confirmation email and either a physical or digital ticket, depending on the event and the ticketing method used.
- If you select digital tickets, they will be sent via email or made available in your customer account. If you select physical tickets, they will be mailed to the address provided at the time of purchase.
- It is your responsibility to ensure the accuracy of the information provided, including your contact details.

Refund and Cancellation Policy
- Refunds on Tickets:
- All sales are final. No refunds will be issued unless the Event is canceled as described below or as provided in this Agreement.
- Non-Refundable Fees: All service fees, processing fees, and handling fees are non-refundable under any circumstances.
- Event Expenses Deduction: In the case of a cancellation and a refund is approved, 19% of the ticket’s face value (excluding any service fees) will be withheld to cover Event-related expenses. This fee is non-refundable and is considered part of the operational costs of producing the Event.
- Refund Request Procedures:
- Eligibility: Refunds may only be requested within 45 days of the Event date. Requests must be submitted in writing via email or our official refund request portal. Refund requests submitted after this period will be denied.
- Required Information: All refund requests must include proof of purchase, such as the ticket confirmation number, purchase date, and any other information required by Green Eyes Productions LLC to verify the request.
- Event Cancellations:
- Event Cancellations by Green Eyes Productions LLC: If the Event is canceled by Green Eyes Productions LLC for any reason, you will be entitled to a refund of the face value of the ticket minus any non-refundable service fees and the 18% Event expense charge.
- Event Postponements or Reschedules: If the Event is rescheduled or postponed, your ticket will remain valid for the new date. No refunds will be provided if the Event is rescheduled.
- Refunds on Prepaid Merchandise:
- Prepaid merchandise will be shipped to the address provided during the purchase process. Once shipped, all sales are final. Any requests for refunds for merchandise must be submitted within 7 days of receiving the merchandise. Refunds for merchandise are subject to a review and restocking fee, which may apply at Green Eyes Productions LLC’s discretion. All Branded Merchandise sells are final, as they can not be restocked.
- Refunds on Prepaid Alcohol:
- If you have purchased alcohol in advance for the Event, you may request a refund. Refunds will be issued minus a non-refundable 19% service fee of the total prepaid alcohol purchase.
- Refund requests for prepaid alcohol must be submitted within 45 days of the Event. No alcohol refund requests will be processed after that time.

Hold Harmless and Indemnity Agreement
By purchasing a ticket to any Event produced by Green Eyes Productions LLC, you agree to the following terms:
- Assumption of Risk:
- You understand and acknowledge that attendance at the Event involves certain risks, including but not limited to personal injury, property damage, illness, and other unforeseen circumstances. You voluntarily assume all risks associated with your attendance at the Event.
- You are responsible for your personal safety, well-being, and actions during the Event and agree to adhere to all safety regulations and guidelines provided by Green Eyes Productions LLC and the Event venue.
- Hold Harmless Agreement:
- To the fullest extent permitted by law, you agree to release, hold harmless, and indemnify Green Eyes Productions LLC, its directors, employees, agents, contractors, volunteers, sponsors, venue owners, affiliates, and all other parties associated with the Event, from and against any and all claims, lawsuits, damages, liabilities, and expenses (including legal fees) arising out of or in connection with your attendance at the Event or your participation in any related activities.
- This hold harmless provision applies to any claims for personal injury, death, property damage, theft, or other losses, whether caused by negligence or otherwise, and covers any claim made by or on behalf of any third party in connection with your participation in the Event.
- Event Cancellations and Postponements:
- Green Eyes Productions LLC shall not be liable for any losses or damages resulting from the cancellation or postponement of the Event, including, without limitation, travel, accommodation, or other personal expenses. The event must reach a certain threshold of ticket sales to cover expenses, if this threshold is not met the Event will be cancelled and refunds will be given per the above cancellation policy.

Ticket Transfer and Resale
- Tickets may not be resold or transferred for a price exceeding the face value of the ticket unless authorized by Green Eyes Productions LLC.
- Unauthorized resale or transfer of tickets may result in cancellation of the ticket without refund.
- Green Eyes Productions LLC reserves the right to cancel any ticket purchase or order if we determine that the purchase was made with the intent to resell tickets at a higher price than the face value.

Privacy and Data Collection
- Collection of Information: Green Eyes Productions LLC collects personal information from customers to process ticket sales, send tickets and merchandise, and communicate about Event details. This information may include your name, address, email, and payment details.
- Use of Information: We may use your information to send you Event-related updates, promotions, and news regarding Green Eyes Productions LLC’s future events. You may opt out of receiving promotional communications at any time.
- Security: We take reasonable precautions to protect your personal information. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

Governing Law and Dispute Resolution
- Governing Law:
- This Agreement is governed by and construed in accordance with the laws of the state of [Insert State], without regard to its conflict of law provisions.
- Arbitration:
- Any dispute, controversy, or claim arising out of or relating to this Agreement, including any claim related to ticket sales, refunds, or any event-related matters, shall be resolved exclusively through binding arbitration.

Modifications to the Agreement
- Green Eyes Productions LLC reserves the right to modify or amend this Agreement at any time without prior notice. Any changes to this Agreement will be posted on our website, and the updated version will be effective immediately upon posting.
- Your continued use or purchase of tickets following the posting of any changes constitutes your acceptance of the modified terms.
